Terms & Conditions

Welcome to ReaVayaVisuals ("we," "our," or "us"). By booking our photography services, accessing our website (www.reavayavisuals.com), or purchasing any of our packages (including Portrait Sessions, Product Photography, and Event Coverage), you agree to comply with and be bound by the following terms and conditions. Please read them carefully before booking.

1. Booking and Reservations

  • Confirmation: A booking is only officially confirmed once a 50% non-refundable retainer/deposit has been paid and a confirmation is sent by ReaVayaVisuals.

  • Session Scheduling: Clients must arrive on time for scheduled shoots. If you are running late, please notify us immediately. Late arrivals may result in a shortened session time to accommodate subsequent bookings, with no reduction in the total fee.

2. Pricing, Payments, and Currency

  • Rates: Prices are listed on our website and are subject to change without notice. However, once a booking is confirmed with a deposit, the quoted price for that specific session will be honored.

  • Payment Terms: The remaining balance for your session or event is due on the day of the photoshoot, IN FULL.

  • Currency: Services are displayed/charged in ZAR (Rand) as applicable to your booking invoice.

3. Cancellation, Rescheduling, and Refunds

  • Client Cancellation: If you need to cancel your booking, the initial deposit is non-refundable as it covers reserved time and lost business opportunities.

  • Rescheduling: We allow one free reschedule if notice is given at least 48 hours prior to the shoot date. Rescheduling is subject to our availability.

  • Weather Policy (Outdoor Shoots): For outdoor sessions, if weather conditions are unfavorable (heavy rain, severe storms), the shoot can be rescheduled at no extra charge.

  • Photographer Cancellation: In the rare event that ReaVayaVisuals must cancel due to illness, emergency, or unforeseen circumstances, we will refund all monies paid (including the deposit) or offer a mutually agreed-upon reschedule date.

4. Image Delivery and Turnaround Times

  • Editing Process: All delivered digital images go through a professional selection and editing process by ReaVayaVisuals. Unedited, raw, or out-of-camera files will not be provided under any circumstances.

  • Turnaround Time: Standard delivery time for final edited images is approximately 1 week after the session or event, unless otherwise agreed upon in writing *with glimpses available a few hours after the photoshoot.

  • Storage: Final galleries will remain active online for 1 year. Clients are strongly advised to download and back up their digital files immediately upon receipt. ReaVayaVisuals is not responsible for archived files after the specified retention period.

5. Copyright and Usage Rights

  • Copyright Ownership: In accordance with copyright law, ReaVayaVisuals retains the full copyright and ownership of all images captured during the session or event.

  • Personal Use License: When you purchase digital files or session packages, you are granted a non-exclusive, non-transferable personal license. This allows you to print, share, and post images on personal social media accounts with proper credit to ReaVayaVisuals.

  • Commercial and Promotional Use: Images cannot be sold, altered, entered into contests, or used for commercial purposes (including product advertising or business branding, unless a specific Product Photography or commercial package was purchased) without prior written consent from ReaVayaVisuals.

  • Photographer's Promotional Rights: ReaVayaVisuals reserves the right to use select images from sessions/events for portfolio display, social media promotion, website showcasing, and marketing purposes, unless the client explicitly opts out in writing prior to the shoot.

6. Client Cooperation and Liability

  • Cooperation: ReaVayaVisuals is not responsible for compromised coverage due to uncooperative subjects, restrictions imposed by event venues, or late arrivals.

  • Limitation of Liability: In the unlikely event of technical failure (e.g., camera malfunction, corrupted memory cards, or loss of data during transit), ReaVayaVisuals’ liability is strictly limited to a full refund of all payments received for that specific booking. We are not liable for any consequential damages, emotional distress, or missed opportunities.

  • Safety: ReaVayaVisuals reserves the right to terminate a session immediately without a refund if the photographer is subjected to hostile, unsafe, or inappropriate behavior.

7. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of South Africa, and any disputes relating to these terms shall be subject to the exclusive jurisdiction of the courts of Johannesburg.
